Klitschko asks Prosecutor General to open a case on power takeover in 2010

Leader of UDAR Vitali Klitschko called on Prosecutor General Pshonka demanding to start criminal proceedings on power takeover in Ukraine in 2010.

In his appeal UDAR leader states that through the decision of the Constitutional Court number 20-rp of September 30, 2010, on alleged return to the Constitution of 1996, a group of top officials by previous consent had committed the crime of falsification of legislation of Ukraine in order to usurp state power.

According to the appeal to the Prosecutor General, the offence is subject to the sanction of Article 109 of the Criminal Code of Ukraine, i.e. actions aimed at changing or violent overthrow of the constitutional order or state power takeover.

"President Yanukovych was fully aware of the illegality of the committed action for usurpation of state power in Ukraine, and shall be accountable for it as well as the other participants in the offense," Klitschko points out.

According to the appeal, people who committed the above offense, also eliminated a number of constitutionally guaranteed rights and freedoms of citizens, and significantly narrowed and restricted other constitutional rights. "Therefore, these people have breeched most of Criminal Code provisions, which provide for penalties for offenses against a person and state. Change the constitutional order by criminal means shows antinational nature of the current government once again," Vitali Klitschko stressed.
